Help to see if you qualify for Legal Aid and with your application

Legal Aid (or Public Funding) is available for a large percentage of legal cases under English Law. However, there are limits to what Legal Aid can cover, and certain types of cases are no longer funded.

If you’re not eligible for Legal Aid or your particular case isn’t covered by Legal Aid, you can move forward as a fee-paying client, and we can discuss legal fee options with you.

While MJR Solicitors does carry out a limited amount of Legal Aid work on specific cases, we won’t always be able to take a case on as we can’t provide the same level of representation due to financial restrictions. And as we only offer limited Legal Aid casework, access to it will depend on your financial situation.

Legal Aid eligibility

Your eligibility for Legal Aid will be means-tested to ensure you qualify for basic legal representation covering some or all of your legal costs. This process will consider factors that include:

  • Your income and financial status
  • Your age
  • Your family circumstances and how many children or dependents you have
  • Your living costs
  • Honest advice

  • Personal one-to-one service

  • Dedicated firm

  • Local experienced team

  • Straightforward outlined costs

Your eligibility will also depend on the type of case and where the case hearing will be. After completing your application forms and providing relevant paperwork, if your Legal Aid application is successful, you may not have to pay any legal fees, and Legal Aid will cover all or some of your costs.

With our Legal Aid experience, our solicitors can help and advise you on whether Legal Aid is available for your case, whether it’s suitable, and whether or not we’re prepared to take your case using Legal Aid.

In the majority of cases, we’ll only be able to help to see if you can qualify for Legal Aid in the first instance and if so, make an application on your behalf. However, if we can help you, we have eligibility and cost information below. If you don’t qualify for Legal Aid, your legal fees will need to be paid privately.

Should your case go to Crown Court for trial, you might qualify for Legal Aid. However, if there’s any change to your financial status, you may need to contribute to the cost of your defence. This will apply if your annual disposable income is above £3,398. If your annual disposable income exceeds £37,500, you won’t be eligible for Legal Aid.

If your Crown Court case delivers a not guilty verdict, your contributions towards your legal costs are refunded with interest.

Defence costs

If you’re eligible for Legal Aid, and we can take your case, any fees are paid to us directly. But a range of factors can affect costs, including a guilty or not guilty verdict – and if you change your plea – and the type of offence and level of seriousness. Any fees we receive are case-specific and can vary accordingly.
