Estate Administration - Fees

For further details on the process and key stages and process please see our Estate administration page. All our estates are administered by Emma Tyler our Wills and Probate expert.

 

From £995 plus VAT and disbursement

That is correct, we offer fees from as little as £995 plus VAT. We have made our Probate & Estate Administration fee structure as simple as possible. We can either work at an hourly rate of £230* plus VAT, or we can agree with you a full estate administration service at a fixed fee.

 

Application for a Grant of Probate only

Where a Will exists and appoints you as the executor of the deceased estate you may wish to employ us to apply for the Grant of Probate but you wish to obtain the deceased estate valuations yourself. We provide you with a helpful guide to assist you in this process which you then complete and return to us. We will complete the necessary inheritance tax forms and statement to be sent to the Probate Registry to obtain the Grant of Probate which we will then provide to you in order to complete the distribution of the assets.

For, estates up to a value of £325,000.00* (where an IHT205 is required)

We can apply for Probate for a fee of £995 plus VAT plus disbursements**

Estates up to a value of £650,000.00* (where an IHT205 plus IHT217 transfer of an unused nil rate band is required and no inheritance tax is applicable)

We can apply for Probate for a fee of £1,495 plus VAT plus disbursements**

Estates with a value between £650,000.00* - £1,000,000.00* (where an IHT205 plus IHT217 transfer of an unused nil rate band is required and no inheritance tax is applicable due to charitable or spousal exemption)

We can apply for Probate for a fee of £2,995 plus VAT plus disbursements*

Estates with a value between £650,000.00* - £1,000,000.00* (where an IHT400 is required and no inheritance tax is applicable due to charitable or spousal exemption)

We can apply for Probate for a fee of £3,995 plus VAT plus disbursements*

Estates with a value between £1,000,000* - £2,000,000.00* (where an IHT400 is required and no inheritance tax is applicable due to charitable or spousal exemption)

We can apply for Probate for a fee of £4,495 plus VAT plus disbursements*

*based on Gross Estate (i.e. all assets without deducting Liabilities)

Full estate fees and over £2,000,000* – On application

For some of the larger estates, we can either work at an hourly rate of £230* plus VAT, or we can agree with you a full estate administration service at a fixed fee, which, as a rough guide, can be between 0.5% and 3% of the value of the estate (subject to a minimum fixed fee of £3,995.00 plus VAT).  We always recommend you speak to us so we can give you a more accurate quote based on the work involved in administering an estate, which can vary significantly.

We will provide you with an estimate of our fees should you wish to complete the matter on our hourly rate.

Main Key Stage (after registration of death)

  • Establish if Will or Intestacy?
  • Gain details of all assets and liabilities.
  • Complete IHT Forms
  • Apply for Grant (or variant)
  • Gather Estate
  • Complete Estate Accounts
  • Distribute Estate

Any disbursements will be outlined at the start of the matter and will incur VAT. The amount and description of expenses and disbursements may vary from matter to matter but will typically include:

  • £273 – Probate Registry Fee
  • £1.50p – per sealed office copy of the Grant of Probate/Letters of Administration
  • £200 (estimate) plus VAT – Section 27 Notice to Creditors
  • £200 (estimate) plus VAT - Asset Search
  • £90 Certainty Will Search (estimate) plus VAT; this performs a National Will Register search. It also includes a REACH search which contacts solicitors closest to the deceased’s last known address and places they may have made their Will. If a Will cannot be located, it places a missing Will notification on the Certainty Will Register

Possible timescales – Sadly, this is far the hardest to calculate, once we have the correct information to apply for Probate this can be as little as two weeks from sending the application, however, Covid restrictions has meant this can now be around twelve weeks from application. We always aim to administer estates as timely as possible and estimate an average of three-six months as being the usual to expect but larger complex matters may take longer.

Our Lasting Powers of Attorney are completed by our Emma Tyler who is our private client expert here at MJR Solicitors working closely with all members of MJR Solicitors. The fees shown are to include all work up to and including registration. (the only additional fees payable are the fees to The Office of The Public Guardian of £82 per document).

Please note in certain circumstances if you are in receipt of qualifying benefits, we can apply for a fee remission or exemption to the £82. Please contact us for further details.

 

COMPLAINTS PROCEDURE

If at any time you have any queries or concerns on any aspect of a matter, then please do not hesitate to contact us. Our complaints procedure is detailed in our client care.

If, your complaint is not resolved to your satisfaction or the eight week period has expired without our final response, you’re entitled to refer your complaint to an Ombudsman Scheme or for Alternative Dispute Resolution (ADR). However, we’ll always be happy to discuss your issues further if you wish to do so, prior to taking this step.

Alternative Dispute Resolution (ADR) is a form of mediation similar, but separate to, the Legal Ombudsman. Companies exist who may be competent to mediate in some disputes but you’d need to obtain our express prior permission to use such a company. This doesn’t apply to contacting the Legal Ombudsman, which you can do at any time. You can find out more about ADR online.

The Legal Ombudsman aims to resolve complaints and assist clients and their solicitors to reach a mutual agreement. There are, however, time limits for submitting complaints to them. These time limits also apply for referrals to the Financial Ombudsman Service:

  • Within six months of receiving our final response
  • Eight weeks after lodging your complaint with us, if you haven’t received our final response
  • Within six years of the date of the act/omission if you haven’t previously complained, or
  • Three years from the date that you should’ve known you had a complaint to pursue and hadn’t complained previously (if the act/ omission occurred more than six years ago). The Legal Ombudsman won’t accept complaints where the act/omission or date of awareness was before 6 October 2010 though. If your complaint is about your bill, you may have a right to apply to the court for an assessment under Part III of the Solicitors Act 1974. There are strict time limits applicable and you may wish to seek independent legal advice:
  • Within one month from the date of the invoice you have an unconditional right to a detailed assessment
  • After one month the Court may impose restrictions
  • After one year from the invoice date, you will lose the right to a detailed assessment, except in special circumstances. The Legal Ombudsman may not consider a complaint about a bill if you have applied to the court for such an assessment.

The Solicitors Regulation Authority can help you if you are concerned about any non-service aspect of the firm.  This includes any issue that you believe should be considered by the professional regulator of solicitors.
