What happens during an FCA investigation?
The FCA has wide-reaching powers, allowing them to investigate and take disciplinary and enforcement action, as stated in the Financial Services Act 2012. The law will enable them to investigate and gain information from authorised firms and their staff (and sometimes people outside the regulated financial sector) where there is an alleged breach of FCA rules.

As a result of rule breaches, the FCA will start an investigation by appointing investigators and sending a written Notice of Investigation to the person or business in question. Scoping discussions will follow this notice to explain the investigation process, why it’s happening, and what happens next.
When the investigation is complete, the FCA will send a summary of the investigation findings to each party involved with details on how it will review the case. The person or business being investigated will have time to respond to the findings. Once the process has finished, the FCA will state their case for resolution unless any involved parties challenge the case.
What can the FCA do while investigating?
The FCA state that not every rule breach amounts to serious misconduct. They will only enter a full investigation if they have good reason to believe serious misconduct has taken place. That can mean an early investigation to prevent any further damage. But during any investigation, the FCA’s enforcement powers include the ability to:
- Suspend or withdraw a firm's FCA authorisation
- Stop individuals from continuing any regulated activities
- Suspend businesses and individuals from continuing regulated activities
- Fine businesses and individuals that breach FCA rules, competition laws, or abuse the market
- Make any disciplinary action public knowledge
- Publish details of warnings, decisions, and final notices
- Apply for court injunctions, restitution orders, and other insolvency orders
- Begin criminal prosecutions to tackle financial crime, such as insider dealing, unauthorised business and false FCA authorisation claims
