What are your next steps after the police take no further action against you?
Suppose you’ve been involved in any police investigation that’s ended with an official statement of ‘no further action’ (NFA) being taken against you. In that case, you could be forgiven for thinking that’s the end of the matter. Aside from your initial feelings of relief that you've been released, are no longer under suspicion, and won't have to go to court, it signals the end of the case. Or does it?
What does ‘No Further Action’ mean?
After an investigation by the police ends by telling a suspect that no further action is being taken against them, it usually means there’s insufficient evidence to make a prosecution. Following this verbal announcement, a formal letter should be sent to you as a suspect or your solicitor to tell you and confirm the investigation is closed.
However, even if you’ve been told no further action is being taken, there’s still a possibility that the investigation could be re-opened in light of any new evidence. Another thing to bear in mind is the Victims’ Right To Review scheme, which gives the victim the right to ask for a review of any police decision not to charge a suspect.

What happens after ‘No Further Action’?
Even though no further action is being taken against you at this point, because you were arrested on suspicion of a criminal offence in the first place, this will remain on your Police National Computer (PNC) record until you’re 100 years old.
Whatever crime you’re accused of, this residual information can seriously affect any potential job roles you might apply for in the future. For example, many employers will seek a standard or enhanced DBS check (Disclosure and Barring), and your arrest will be evident, resulting in many uncomfortable questions and possibly a refusal of a job offer.
But it’s not just your employment opportunities that can be affected. Information held after no further action can also influence voluntary positions and damage travel opportunities, whether for personal or professional reasons.
What are your next steps?
The good news is that once you’re released with no further action being taken, any subsequent issues can all be avoided by having your record deleted. You can challenge the police directly with a comprehensive reason why they should delete your caution and arrest record. But you can also seek legal advice from experienced criminal defence lawyers like MJR Solicitors, who can do it on your behalf.
