If you’ve been interviewed and released under investigation, what happens next?
If you’ve been interviewed by police and then ‘released under investigation’, you might be confused about what this means. As it’s an open-ended statement with no conditions and no fixed date of when the investigation will end, you’d be right to worry about how long it could last and what can happen next, leaving your life in limbo.
What does released under investigation mean?
If the police suspect you of committing a crime, they can take you in for an official interview. Once questioning is complete, you may be ‘released under investigation’ for an unspecified amount of time. In theory, it gives the police time to continue their ongoing inquiries, gather evidence, and question other suspects.
But although you’re not being held in custody and are free to go home and carry on your daily life, you’re still a suspect and could be asked back to the police station at any time. While you should be notified of the outcome of the investigation at some point, there’s no limit on how long it can take.

Is ‘released under investigation’ different from released on bail?
While police regularly release suspects under investigation, the process is, unfortunately, open-ended and very different to being released on bail. If you’re released on bail, the statutory police tine limit is up to 28 days, giving you a date and time when you must return.
During the 28 days, the investigation will be ongoing and when you return, you should expect a decision regarding your release. If the police want to keep you on bail, a senior officer must apply for an official bail extension.

Being released under investigation is open-ended, so being in that position is stressful when you're innocent. And with such uncertainty, many people are forced to put their life on hold with the police under no obligation or time limit to update you.
Some investigations can continue for many months or longer, increasing the uncertainty you might feel.
