To prepare for this, you need to choose who you’d want to make decisions for you and make it legal and official. Whoever you choose will be your ‘attorney’ and you can choose more than one person. You can appoint them with a legal document called a ‘lasting power of attorney’ (LPA). By giving your attorney specific guidance, they will be able to communicate your choices for you. Option 1: Your attorney can make decisions as soon as you register your LPA (but only with your permisson). Option 2: Your attorney can only make decisions if you cannot make decisions for yourself. Important things to consider It’s important to understand that option 2 can create practical issues for your attorney. They may need to provide evidence that you’re unable to make decisions every time they need to make a decision — this could add delays and costs. If you want to make it as easy as possible for your attorney to make decisions, we recommend you choose option 1. They’ll need your permission to make any decisions as long as you can still make decisions for yourself. If you have doubts about choosing option 1, you need to think about whether you have chosen the right people as your attorneys and whether you trust them fully. Choosing your attorney or attorneys Now you’ve told us what’s important to you, the next step is to choose who you’d want to make these decisions for you. You need to ask yourself, do you trust this person to make decisions for you and act in your best interests and do you think they would make the same decisions you would make for yourself? Who can be your attorney You can ask anybody to be your attorney as long as they’re over 18 and have mental capacity. If you choose more than one attorney You can choose as many attorneys as you want, but too many attorneys can make things difficult because they’ll need to work together.
